Year after year, I have a dependent that gets claimed by another person.  As a result, I have to either mail my return in or file an amended return at a later date.   What can I do about this? 

Unfortunately, as of this writing, the only sure fire way to counter this is to beat the other person to the punch by being the first to file your return as quickly as you can.   It helps if you can secure your W-2 form from your employer before the 17th of January. 

For the most part, individuals that claim dependents that they are not authorized to claim know when the first day of filing commences and tend to file before the end of the month.  They know that the other individual will still be waiting on their W-2 form and will not be able to file right away, giving them an advantage to file and claim the dependent before the other person knows what has happened
.     

If at any point during the tax filing season you are able to ascertain the identity of the person who continuously claims your dependent without authorization, you may report them by completing Form 3949A or by calling 1-800-829-0433 between the hours of 7am to 7pm Monday through Friday.
